Learned Counsel appearing for the petitioner submits that a representation made on 21st September, 2019 before the District Primary School Council, Purulia regarding withholding salary of the primary assistant teacher since appointment has not been dealt with the District Primary School Council till date.

Ms. Bhattacharya, learned Counsel appears for the State and Mr. Vaisya, learned Counsel appears for the Council.

Heard all the parties.

As the representation dated 21st September, 2019 has not been considered by the District Primary School Council, Purulia, the Chairman, District Primary School

Council, Purulia being the respondent no. 5 in the instant application is requested to consider the representation of the petitioner. The writ petitioner is directed to serve a copy of this order along with a copy of the writ petition to the District Primary School Council, Purulia within 7 (seven) days from today. The Chairman, District Primary School Council, Purulia is requested to give an opportunity of hearing to the petitioner and to allow the petitioner to produce all the relevant documents at the time of hearing and to pass a reasoned order within twelve weeks from today. The learned Chairman is also requested to communicate the reasoned order to the petitioner at an earliest.

Since I have not gone into the merits of the writ petition, all the points are left open for consideration by the learned Chairman.

The writ petition being WPA 5310 of 2021 is accordingly, disposed of.

There will be no order as to costs.

Since no affidavit have been invited, the allegations made in the writ petition are deemed to have been denied. Urgent certified website copy of this order, if applied for, be made available parties upon compliance with the requisite formalities.
