The petitioner is aggrieved by the fact that substantial amount of arrears have accrued in connection with M. Ex. No. 305 of 2021 which is pending before learned Judicial Magistrate, 7th Court, Alipore. According to the petitioner, the said amount is Rs.66,500/-.

The learned advocate appearing for the petitioner submits that the quantum of maintenance so awarded by the learned Magistrate in the application under Section 127 of the Code of Criminal Procedure is Rs.3500/- per month. Having considered the dues which have accrued, I direct that by way of instalments preferably a sum of Rs.10,000/- to be paid per month towards the arrear along with Rs.3500/- per month towards the regular maintenance aggregating to a sum of Rs.13,500/- per month till the arrears are completely cleared.

The learned Magistrate would ensure that by 30.09.2024, the whole of the arrears are diluted in connection with M. Ex. Case No. 305 of 2021 and no time be afforded to stretch the time beyond the date so fixed. With the aforesaid observations, the revisional application being CRR 761 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
