The Superintendent of Police, Paschim Midnapur has not considered a representation dated 12.02.2023 for protection and further complaint against the private respondents.

Insofar as the further complaints of offence by the private respondents, the petitioner may avail the mechanism under Section 156(3) of the Cr. P. C. The request for security to the petitioner is concerned, the same may be considered by the SubDivisional Police Officer, Kharagpur Town, Paschim Midnapur.

Mr. Banerjee, learned counsel for the State submits that the security cover is continuing for the petitioner.

Mr. Mukherjee, learned counsel for the petitioner, however, submits that since after filing of the charge sheet in the proceedings under SC & ST Act, the security cover has been withdrawn.

The Sub-Divisional Police Officer, Kharagpur Town, Paschim Midnapur shall take a suitable decision in the matter of security cover to the petitioner in accordance with law within a period of one week from the date of receipt of a copy of this order.

Since no affidavit has been used by the respondents, the allegations made in the writ petition shall not be deemed to have been admitted by them. The writ petition is disposed of.

There will be no order as to costs.
