1. Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. Other than the statement of co-accused, there is no other incriminating material available against him. Charge sheet has been submitted.

2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. She relies on a report, which is taken on record. As per the report, other than the statement of the co-accused there are CDR records showing that at the relevant time there were phone calls made between the petitioner and the principal accused from whom the contraband was seized.

3. Considering the above, the other materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

4. Accordingly, the application for anticipatory bail is rejected.

5. The Investigating Officer shall be at liberty to make necessary prayer before the learned Magistrate concerned to incorporate the call details record by way of a supplementary charge sheet before the Magistrate. (Jay Sengupta, J.)
