It appears from such report that the court proceeded to split up the case between the persons who are in custody and the person who is still absconding.

The Court is informed that the next date will be fixed by the learned trial judge.

In such circumstances, the prosecution will make necessary application before the learned trial judge for fixing date of trial.

Learned trial judge is also requested to fix consecutive dates for trial and endeavour to adhere to the same. The learned trial judge is also requested to not to grant any unnecessary adjournment to either of the parties.

Considering the gravity of the offence and the involvement of the petitioner as transpiring from the materials available in the case diary including the dying declaration of the victim, we are unable to enlarge the petitioner on bail. CRM (DB) 715 of 2022 is rejected.
