Ms. Pampa Dey (Dhabal) ....for the petitioners Mr. Uttiya Ray, Mr. Arnab Mandal ....for the respondent nos. 6 and 7 This petition claims to have been filed in the name of the petitioner who is a senior citizen by the other son, who was not the party in this matter. The target is the second son and daughterin-law being respondent nos. 6 and 7. It is submitted that the second son is torturing the petitioner. The second son admits that he is not living with the same premises. The petitioner also admits that she has gifted a portion of the premises to him and is living there.

The petitioner's application to the SDPO for cancellation of a gift of deed in favour of the second son, has been refused.

This Court sees no reason to interfere in the matter. The writ petition is dismissed.

This Court is not inclined to impose costs.

However, in the facts and circumstances, the

petitioner and particularly, the other sons of the petitioner are hereby warned against such frivolous litigation in future.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
