For the State The petitioner has filed the instant application for bail under Section 439 of the Code of Criminal Procedure in connection with Baishnabnagar Police Station Case No. 410 of 2020 under Sections 489(B)/489(C)/120B of the Indian Penal Code (G.R.Case No. 3279 of 2020). The petitioner says that no foreign currency was recovered from his possession and he has been apprehended unnecessarily and is languishing in jail for 220 days. Our attention is drawn to the seizure list and the statements recorded under Section 161 of the Code of Criminal Procedure. Prima facie, it appears that the foreign currency was recovered from the house of the father of the petitioner, where the petitioner is living as a member therein and thus, we do not think that it is a fit case where the petitioner should be enlarged on bail at this stage.
