2021-02-02Hon'Ble Justice Ravi Krishan Kapur2 pages

February 02, 2021 ARDR (40) WPA 2489 of 2014 Ear Ali Mallick Vs.

The State of West Bengal & Ors.

Mr. Gopal Chandra Ghosh, ...for the petitioner.

Mr. Arindam Chattopadhyay, ...for the State.

The grievance of the petitioner is directed against the refusal of the respondent authorities to consider a representation of the petitioner dated 31st July, 2013 for wrongful fixation of pay of the petitioner.

Mr. Chattopadhyay appears on behalf of the State respondents and submits that he has no objection if the District Inspector of Schools, South 24 Parganas, being the respondent no.3 is directed to consider and dispose of the representation of the petitioner appearing at page 81 (Annexure P/19 to the petition).

In view of the submissions made on behalf of the State, I direct the respondent no.3 being the District Inspector of Schools, South 24 Parganas to consider and dispose of the representation of the petitioner within a period of eight weeks from date on receipt of this order and pass a reasoned order.

It is needless to mention that nothing in this order will be binding on the respondent no.3 on the merits of the case while considering the representation of the petitioner.

With the aforesaid directions, WPA 2489 of 2014 is disposed off. However, there will be no order as to costs.

It is expected that the respondent no.3 will communicate his reasoned decision to the petitioner within a period of four weeks from the date of the order.
