For the Respondent/Husband In view of the settlement arrived at between the parties the appeal was adjourned in order to enable the parties to file an application for mutual divorce under Section 13B of the Hindu Marriage Act, 1955 before the learned District Judge.

Learned District Judge decreed the MAT Suit no. 2969 of 2022 under Section 13B of the Hindu Marriage Act, 1955 on mutual consent on 20th September, 2022.

The certified copy of the said decree is produced before us and the same be kept with the record.

In view of the above, the appeal stands disposed of.

The impugned order dated 18th September, 2020 is set aside in view of decree passed the Mat Suit No. 2969 of 2022 by the learned District Judge on mutual consent.

In view of settlement between the parties and disposal of the appeal, nothing remains to be decided in the application for maintenance and the same being CAN 2 of 2021 stands dismissed. (Siddhartha Roy Chowdhury,J.) (Soumen Sen, J.)
