The learned advocate appearing for the Panchayat Samity submits, upon instructions, that the E-auction was cancelled because of various reasons. The reasons as submitted in Court are not reflected in the order of cancellation of the E-auction that is impugned in the instant writ petition. As it appears that the order of cancellation is an unreasoned one, the same cannot be held to be valid in the eye of law.

Accordingly, the order impugned dated 9th February, 2021 being Memo No. 1419 is set aside and quashed.

The Panchayat Samity shall intimate the reasons in detail, if any, for cancellation of the E-auction called on 28th December, 2020 vide memo no. 1205.

WPA 5331 of 2021 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
