Petitioner has informed the Police authority is that he intends to dismantle the existing structure and intends to construct a building which he has purchased to that effect whenever the masons are engaged the private respondents are flexing their muscles power to restrain the masons from doing their job.

Report submitted by State reflects that on the basis of the complaint in the year 2020 Binpur Police Station case No.

60/2020 was registered for investigation and on completion of investigation charge sheet has been submitted before the jurisdictional Court. Police authority has denied that

no assistance was rendered to them whenever complaint was forwarded.

Learned advocate for the private respondents submits that he is in possession, however attention of the Court has been drawn to the decree passed in Title Suit No. 140 of 2014 wherein the learned Civil Judge, Junior Division, Jhargram has been pleased to dismiss the suit and vacate the interim order. Since the nature of the dispute is absolute by civil dispute the interference of the Police authority would be called for in circumstances, if the situation is blown out of proportion. To that effect if a complaint is received appropriate steps would be taken by the authorities. With the above observations W.P.A. 4802 of 2024 is disposed of.

The reports submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.
