Learned advocate appearing for the petitioner submits that the petitioner was implicated in connection with the instant case for alleged recovery of 322 grams of brown sugar and is in custody for 1 year 7 months. In spite of directions passed by this Court in CRM(NDPS) 892 of 2025, no witness till date has been examined by the prosecution.

Learned advocate for the State opposes the prayer for bail but admits that no witness till date has been examined. Prosecution has relied upon 11 witnesses to prove its case. Considering the period of detention of the present petitioner, as a matter of last chance, I direct that at least within three months from the next date so fixed, prosecution would

complete five witnesses. In case five witnesses are not concluded within the said period, learned special court would release the petitioner on bail. The aforesaid compliance would be subject to the petitioner co-operating with the progress of the trial of the case. With the aforesaid observations, CRM(NDPS) 394 of 2026 is disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
