Hossain Ms. Sanjida Sultana Mr. Prithwiraj Biswas ... for the respondent nos. 5- 8 Re The petitioner is aggrieved by the fact that in spite of warrant of arrest being issued by the learned ACJM, Sealdah in connection with Beniapukur P.S. Case No. 1 dated 02.01.2024, the respondent no.4, till date, could not be traced out because of non-execution in respect of the warrant of arrest.

State has submitted a report which reflects that the respondent no.4 is staying within the jurisdiction of Entally Police Station.

However, he is presently in a foreign country, i.e., Dubai.

In view of the respondent no.4 being in a foreign country, the learned Magistrate is directed to issue necessary processes against the respondent no.4 who is evading the process of law by sending information to the respective offices which would include Ministry of External Affairs and the Indian Embassy at Dubai for execution of the warrant. If required, the learned Magistrate will inform the Passport Authorities regarding the list of cases pending against the respondent no.4.

Learned advocate for the respondent nos. 5 to 8 submits that the petitioner is well aware that the respondent 4 has been staying at Dubai.

Be that as it may, it is for the respondent no.4 to appear and take steps in respect of the criminal cases pending.

As directed above, the learned Magistrate would inform the aforesaid offices so that the respondent no.4 can be compelled to take steps in connection with the criminal cases pending in India.

With the aforesaid observations, WPA 4727 of 2025 is disposed of.

Pending application, if any, is also disposed of.

Report so submitted be kept with the record.
