Mr. Saptarshi K. Mal Mr. Debabrata Roy ...for the petitioners A direction to secure the expeditious disposal of two suits being Title Suit no. 70 of 2011 and Title Suit No. 50 of 2016 tried analogously, now pending before the learned Civil Judge, (Junior Division), 2nd Court at Arambag, is the ultimate relief, as sought for in this case.

Learned advocate for the petitioners submits that in the court below, the suits are at the evidence stage and the witness action of PW-1, has already been concluded.

The only contention expressed by the learned advocate for the petitioners, is against the delay caused against the disposal of suits, referred above.

In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary.

The service upon the opposite party is thus dispensed with, so far as the present revisional application is concerned.

Accordingly, the learned Civil Judge, (Junior Division), 2nd Court at Arambag is requested to ensure expeditious disposal of two suits, referred hereinabove tried analogously, after causing disposal of the interlocutory application, if there be any pending, providing sufficient opportunities of hearing to both the parties, but without granting any unnecessary adjournment to either of the parties, unless it is extremely unavoidable.

The petitioners are directed to communicate this order to the learned Court below, opposite party and their advocates as well.

With this direction and observations, this revisional application stands disposed of.

Urgent photostat certified copy of this order duly applied for, be given to the parties upon compliance of all requisite formalities.
