The issue raised by the petitioner in the present contempt petition is non-compliance of the Court's order passed in W.P.C.T. 243 of 2024 on 3rd December, 2024.

The learned counsel for the petitioner submits that all together 53 members of the petitioner Union have approached the authorities for availing consideration in terms of the order passed in O.A. No. 1350 of 2016, in view of liberty granted by this Court in W.P.C.T. No. 243 of 2024. Though they have made applications in the last week of December, 2024, the authorities are dragging their feet in the matter.

The learned senior counsel for the Union of India on the other hand submits that the contemnors, in terms of the order passed in W.P.C.T. No. 243 of 2024 are obliged to consider the issue in terms of the order passed in O.A. No. 1350 of 2016. He has thus raised a preliminary issue regarding petitioner approaching this Court whereas the order which is to be complied and which allegedly is being violated, has been passed in O.A. No. 1350 of 2016 by the Central Administrative Tribunal, Kolkata Bench. He submits that they have rushed to this Court in a hurry whereas upon instructions, he submits that despite there being no time frame in the order passed in W.P.C.T. No. 243 of 2024, the authorities are taking steps in the matter and proceeding to ensure compliance of the Court's order in letter and spirit.

The learned senior counsel has also shown this Court a communication in this regard, details of which we do not wish to record since it is a communication between him and his client.

Since the authorities are taking steps, we do not wish to proceed further in the present proceedings. We, however, leave it open to the petitioner to avail remedies before the appropriate forum for compliance of the order in accordance with law, should such occasion arise.

The contempt application is disposed of.
