[ Petitioners in CRAN 1 of 2023 are seeking waiver of two conditions imposed while granting anticipatory bail in the order dated February 28, 2023.

Learned Advocate appearing for the petitioners submits that both the petitioners are employees of the State Bank of India and that, it is difficult for the petitioners to secure leave of absence from the bank on the dates of hearing every time. He submits that, petitioners may be permitted to apply under Section 317 of the Code of Criminal Procedure. State is represented.

We granted anticipatory bail by the order dated February 28, 2023, inter alia, on the condition that the petitioners will participate at the trial and will be present on each date fixed for appearance of the accused.

Considering the facts and circumstances of the present case, the requirement of the petitioners being present on the dates fixed for their appearance cannot be waived.

In such circumstances, we are unable to accede to the request of the petitioners.

IA No.: CRAN 1 of 2023 in C.R.M.(A)866 of 2023 is dismissed without any order as to costs.
