1. None appears on behalf of the appellants.

2. State is represented.

3. In pursuance of the direction passed by this Court, the Superintendent of Police, Diamond Harbour Police District submitted an explanation which is handed over by the learned advocate for the State during the course of hearing.

4. It appears from the said report that the sole appellant/convict, Kuddus Sk. has been expired during the pendency of this appeal on 24.03.1997. As the family members of the said accused were unable to produce any death certificate of the appellant/convict, Kuddus Sk., concerned police officer collected a certificate from the Prodhan, Chak Enayetnagar Gram Panchayat which also affirms the death of the victim Kuddus Sk.

5. As the sole appellant/convict Kuddus Sk has been expired, the instant appeal be and the same stands abated against him.

6. Accordingly, the instant appeal be and the same being CRA 188 of 1995 is dismissed as abated.

7. Let a copy of this order along with the TCR be sent down to the learned Trial Court immediately.

8. Urgent photostat certified copy of the order, if applied for, be given to the parties upon complying with all legal formalities. (Prasenjit Biswas, J.)
