1. The learned advocate for the writ petitioner in WP.ST 46/2026 submits that he is under written instructions from his client that the petitioner's request for acceptance of resignation was considered favourable to the writ petitioner by an order dated 15th June, 2026 issued by the Special Secretary to the Government of West Bengal. The written instructions dated 17th June, 2026 and the order dated 15th June, 2026 issued by the Special Secretary are handed over to the Court, which may be kept with the records.

2. From perusal of the order dated 15th June, 2026, it appears that the Special Secretary has communicated the acceptance of the petitioner's request for resignation from the post of Assistance Professor, Department of Rheumatology with effect from 22nd August, 2025, leading to forfeiture of his past service. He is also required to refund to authorities his two months' salary in terms of the Rule 34A (2) of the West Bengal Service Rules, Part-1. The formal release order was to be issued

after completion of the formalities, including clearing of financial obligations of the petitioner, if any.

3. In view of the issuance of such order dated 15th June, 2026, the writ petitioner by the written instruction has requested the learned advocate for withdrawal of the writ petition being WP.ST 46/2026.

4. Considering the above facts and circumstances, and the written instruction, we permit withdrawal of the writ petition.

5. The present writ petition arises out of a proceeding before the West Bengal Administrative Tribunal (for short Tribunal) being O.A. 496/2025.

6. In view of the above noted development, subsequent to filing of the writ petition, it is submitted by the learned counsel of the writ petitioner that the pending original application has become infructuous.

7. The present writ petition is dismissed in the above terms.

8. The original application being O.A. 496/2025 pending before the Tribunal is, accordingly, disposed of.

9. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
