Learned Counsel for the petitioner submits there is a civil dispute between the petitioner and her brother-in-law, a co-accused. He has been falsely implicated. He prays for anticipatory bail.

Learned Counsel for the State opposes the prayer for anticipatory bail.

We have considered the materials on record including the statement of the victim lady. She alleges petitioner had caught hold of her in the field. Thereafter her brother-in-law came, assaulted her and committed rape. Presence of the petitioner at the place of occurrence and his participation in the offence is made out. Under such

circumstances and in view of the nature of crime we are not inclined to grant anticipatory bail to the petitioner.
