Heard learned counsels for the parties.

Bail prayer of the petitioner was turned down on earlier occasions considering the material on record. The petitioner is in custody for more than 4 years and renews his prayer.

Learned counsel for the petitioner submits that there is no incriminating material against the petitioner which justifies his further detention. None of the witnesses has named him before the learned trial Court.

Learned counsel for the State opposes the prayer and points out that passbook, credit card and other articles of the victim have been recovered either from the custody of the petitioner or pursuant to his leading statement. The petitioner has been identified by the employee of the guest house where he put up at the time of the incident.

Considering the material available on record connecting the petitioner to the alleged offence, prayer for bail is rejected at this stage.

However, in view of the period of incarceration of the petitioner, learned trial Court is directed to take the proceeding to its logical conclusion as expeditiously as possible, without granting any unnecessary adjournment to either of the parties, in accordance with law. The application for bail is thus disposed of. Case diary be returned.
