An appeal lies against the said judgment and decree.

In view thereof, this Court is not inclined to entertain this application under Article 227 of the Constitution of India.

As prayed for by the learned advocate appearing for the petitioner, leave is granted to the petitioner to withdraw this application with liberty to approach the appropriate forum in accordance with law.

In view thereof, CO 716 of 2025 stands dismissed as withdrawn with liberty to the petitioner

to challenge the judgment and decree passed in Title Appeal No. 85 of 2017 before the appropriate forum and in accordance with law.

Learned advocate on record of the petitioner is permitted to take back the original certified copy of the judgment and decree by replacing the same with a Photostat copy thereof.
