Learned advocate appearing for the petitioner submits that petitioner is in custody for eleven months and has been implicated for alleged recovery of 20.800 kgs of ganja.

Learned DSGI, appearing for the NCB opposes the prayer for bail and submits that charges have already been framed and date has been fixed for evidence of PW1. There are materials to show that there are overwhelming materials against the petitioner. It has been submitted that the prosecution intends to examine 10 witnesses, consequently, I am of the view that some time will be required to complete the trial. As such, having regard to the quantity of seizure and the period of detention of the present petitioner, I am of the view that the petitioner may be released on bail. As such, the prayer for bail of the petitioner is allowed.

Accordingly, petitioner namely, Md. Naushad shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Court under NDPS Act, City Sessions Court, Calcutta.

If on bail, shall not leave the jurisdiction of district of Howrah without the prior permission of the learned Special Court and for a period of next three months the petitioner shall meet with the investigating officer or any officer deputed by the Superintendent of Police, Narcotic Control Bureau. Petitioner shall be physically present on each and every date fixed before the learned trial Court.

If there are any violations of the aforesaid conditions, the learned trial Court/Special Court will be at liberty to cancel the bail without further reference of this Court.

With the aforesaid observations, the prayer for bail in CRM (NDPS) 396 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
