The learned Government Pleader has passed on to the Court written instructions received from his client, namely, the Director of Medical Education, West Bengal and the same is kept on record.

The instructions dated 23.03.2026 states that the petitioner prayer for resignation on 11.07.2025, resigning from the post of Assistant Professor, Department of Anaesthesiology, R.G. Kar Medical College, Kolkata has been decided to be accepted with effect from 01.08.2025, subject to integrity clearance which is yet to be issued by the State Vigilance Commission. It further states that the same is required to be issued by the Vigilance Branch, Health & Family Welfare Department, Government of West Bengal.

The learned advocate for the writ petitioner submits that the petitioner's grievance in the writ petition is substantially redressed in view of the instructions dated 23.03.2026.

In the circumstances, no adjudication is called for in the present proceeding and the relief having become infructuous; pendency of the writ petition would be a futility.

However, before parting with the case, we only record our disapproval with the order dated 23.03.2026 in as much as it seeks 3 to 4 months for completing such formalities. We are of the view that the same be done within a reasonable time, preferably within six (06) weeks from the date of receipt/production of a copy of this order before the Director, Medical Education.

With such direction, the writ petition is disposed of.

The writ petition arises out of a pending Original Application bearing O.A. No. 501 of 2025 before the West Bengal Administrative Tribunal.

There is no dispute that in view the present order, the O.A. also has become infructuous. O.A. No. 501 of 2025, therefore, also stands disposed of accordingly.
