Report submitted by the NCB be kept with the record. Learned advocate appearing for the petitioners submits that the petitioners are in custody for about 300 days. Charges have already been framed in the instant case and as such petitioners may be released on bail.

Learned advocate for the NCB on the other hand opposes the prayer for bail and submits that the subject matter of recovery in the present case is 54 kgs of ganja out of which a part was recovered from the present petitioners also.

Having considered the quantum of seizure which although involves six persons, I am not inclined to release the petitioners on bail at this stage. In the alternative, I direct the learned Special Court to prepone the evidence of the seizure list witnesses.

Petitioners would renew their prayer for bail after the evidence of seizure list witnesses are over.

Accordingly, CRM (NDPS) 400 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
