Learned advocate appearing for the petitioner submits that petitioner is in custody for 153 days and has been falsely implicated in connection with the instant case. It has been submitted that the petitioner is brother-in-law who has been falsely roped in the instant case because of the victim having relationship with the different person.

Learned advocate for the State has opposed the prayer for bail and has drawn the attention of the Court to the statement under Section 183 of BNSS.

I have taken into account the materials appearing in the Case Diary and I am of the opinion that petitioner is not similarly situated as other accused who have been released on bail. As charge-sheet has already been submitted, I direct the learned trial Court to

overcome the stage of consideration of charges and thereafter fix date for evidence of the victim.

Petitioner would be at liberty to approach this Court after the evidence of victim is completed.

At this stage, CRM (M) 579 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
