On the prayer of the petitioners liberty is granted to the petitioners to deposit deficit court fees within tomorrow i.e. November 15, 2022.
The contention of the petitioners is that the petitioners are the heirs of the original owner of the plots in question which were acquired by the State-respondents for reconstruction of the Aila affected Sundarban area in 2012. The original owner of the plots in question expired in the meantime and though the petitioners approached the appropriate authority as heirs of the original owner, several times, no compensation was paid to them. The petitioners seek liberty to submit a comprehensive representation in this regard before the concerned authority and pray for direction upon the concerned authority to consider the said representation at the earliest.
Learned counsel appearing on behalf of the Staterespondents submits that the 3rd respondent be directed to
consider the representation submitted by the petitioners in accordance with law.
Upon consideration of the submission made by the learned counsels appearing on behalf of the parties the writ petition is disposed of with liberty to the petitioners to submit a comprehensive representation before the 3rd respondent ventilating their grievance within 7 days from date. The 3rd respondent is directed to consider and dispose of the representation within two months from the date of receipt thereof after affording reasonable opportunity of hearing to all interested parties including the petitioner, in accordance with law.
The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above observations and directions this writ petition is disposed of.
There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
