D.Hira No one is appearing for any of the parties in this appeal. Record reveals that previously the appellant was represented in Court, on 18.04.2011 and not since thereafter. Record reveals that the appellant has preferred an application under Section 5 of the Limitation Act to pray for condonation of delay of 19 days in filing this appeal, though no one has moved the same today in spite of the matter being called on for the second time. Hence the same is taken up for disposal, particularly in view of the long pendency of the instant case.

On perusal of the grounds mentioned therein, it appears that the same are not sufficient to justify the delay in filing the instant appeal. Accordingly, appellant's prayer under Section 5 of the Limitation Act for condonation of delay of 19 days in filing this case is dismissed. Consequently, the appeal is also dismissed.

All pending applications, if any, are consequently disposed of. Certified website copies of this order, if applied for, be supplied to the parties subject to compliance with all the requisite formalities. (Rai Chattopadhyay, J.)
