The petitioner has assailed the order dated 19th February, 2025 passed by the learned Additional Chief Judicial Magistrate, Haldia in connection with GR 293 of 2018 directing issuance of warrant of arrest against him.
Learned counsel for the petitioner submits that the petitioner was released on bail on 27th July, 2018 and appeared before the learned Court regularly. The petitioner filed an application before the learned Judge, Special Court, Tamluk, Purba Medinipur under Section 228(1) of the Code of Criminal Procedure seeking remand of the case to the learned Additional Chief Judicial Magistrate, Haldia on the ground that the allegations made therein did not attract the provision under Section 409 of the Indian Penal Code. The application of the petitioner was allowed and the case remanded to the learned Additional Chief Judicial Magistrate fixing 19th February, 2025 for appearance of the petitioner.
The petitioner failed to appear before the learned Additional Chief Judicial Magistrate on 19th February, 2025 for which warrant of arrest was issued against him. The petitioner undertakes to surrender before the learned Additional Chief Judicial Magistrate, Haldia within a fortnight from date. If the petitioner surrenders before the learned Magistrate within a fortnight from date, he may be allowed to remain on the same bond.
In the event the petitioner fails to surrender before the learned Magistrate within the stipulated time frame, the learned Magistrate shall
be at liberty to take necessary steps against the petitioner in accordance with law without further reference to this Court. Warrant of arrest issued against the petitioner be stayed till 20th March, 2025.
CRR 947 of 2025 is disposed of.
