The petitioner is the wife who seeks transfer of Matrimonial Suit No.1562 of 2018, which is pending before the learned Additional District Judge, 2nd Court at Barrackpore to the court of the learned Additional District Judge, 1st Court at Sealdah.
According to the petitioner, she has to travel around 30 kms. from her residence, which is at Tangra. The learned advocate for the husband submits that there is already a proceeding pending in the Barrackpore court, at the instance of the wife. That the husband feels unsafe to go to Sealdah because the wife entangled the husband in various police cases. That the wife is regularly travelling to Belgharia as the child studies there. Reference to paragraph 9 of the application has also been made. In my view, the distance between Tangra to Barrackpore is approximately 30 kms. The places are wellconnected by bus and train. The petitioner is also used to travelling to Belgharia, which is close to Barrackpore. Thus,
this Court does not find any reason to pass any orders for transfer.
Accordingly, the application is dismissed.
There will be no order as to costs.
All the parties are directed to act on the basis of the server copy of this order.
