Mr. Biswabrata Basu Mallick Mr. Sayan Ganguly ... for the State Ms. Koyeli Bhattacharyya ... for the respondent no.4 This is an application under Article 226 of the Constitution of India wherein the writ petitioners are teaching and non-teaching staff of the Kalinagar Junior High School, Nadia and are seeking recognition of the said school on the basis of their representations dated December 1, 2020. The other prayers have been made but the same have been waived by the petitioners as of now.

I find that the letter dated 11th April, 2014 had been written by the Assistant Secretary, School Education Department, Government of West Bengal to the District Inspector of Schools (S.E.), Nadia directing him to cause a further D.L.I.T.I. for the school in question in terms of the Department's order No.78-SE/S dated 14.1.2013. The letter also requested the Secretary of the concerned school for fulfilling the deficiencies mentioned in the earlier D.L.I.T.I. in connection with recognition of the school.

I have heard learned Counsel for the appearing parties and perused the materials on record.

Accordingly, I direct the District Inspector of Schools (S.E.), Nadia to cause a further D.L.I.T.I. as per Department's own letter dated 11th April, 2014. The Secretary, Kalinagar Junior High School, Nadia is also directed to comply with the above letter dated 11th April, 2014 within a period of four weeks. The entire process of causing the further D.L.I.T.I. should be completed within a period of twelve weeks from date.

I make it clear that I have not gone into the merits of this case.

With the above directions, this writ petition is disposed of.

Since no affidavit-in-opposition is called for, allegations made in the writ petition are deemed not to have been admitted.
