The petitioner is aggrieved by the fact that in spite of informing the local police station as well as the Superintendent of Police, Basirhat Police District, no steps have been taken and the private respondent has been illegally occupying the petitioner's property by force which is a cultivable agricultural land. The petitioner also complains of having been threatened.

Since the petitioner has admitted that the land in issue, which the petitioner claims to be his own, has been already illegally occupied, until and unless there is a specific direction from an appropriate court of law or an appropriate authority entitled to decide the right, title and interest of a property, the police authorities will not be able to render appropriate assistance. If the petitioner approaches the civil court or the appropriate authority and there are directions upon the police

authorities, the police authorities would respect and obey such order.

With the aforesaid observations, the writ petition being WPA 4773 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
