This is an application for expeditious disposal of S.C. No. 13 of 2012 corresponding to G.R. No. 3352 of 2009 arising out of Muchipara Police Station Case No. 406 of 2009 dated 24th December, 2009 under Sections 498A/ 406/ 307 /34 of the Indian Penal Code presently pending before the learned Additional Sessions Judge, 2nd Fast Track Court, Bichar Bhavan, Calcutta.

On perusal of the averment made in the instant revision and having heard the learned Advocate for the petitioner this Court is of the view that the instant revision can be disposed of here and now with the assistance of the learned Advocate for the State. Accordingly, Mrs. Saryati Dutta

learned Advocate is requested to assist this Court on behalf of the state. Appointment of Mrs. Saryati Dutta learned advocate be regularized by the learned Legal Remembrancer, Government of West Bengal. 3.

It is submitted by the learned advocate for the petitioner that the case was initiated on the basis of a written complaint made by the petitioner herein before the Muchipara Police Station on 24th December, 2009 against the opposite party no. 2 to 5. After completion of investigation, chargesheet was submitted and charge was framed on 24th July, 2013 against the opposite party no. 2 to 5 under section 498A/307/406/34 of the IPC fixing 9th September, 2013 to 11th September, 2013 for evidence. During the period from 29th November, 2013 to 22nd November, 2022, 10 prosecution witnesses have been examined and evidence of PW11 was continuing. Several adjournments were taken and next date was fixed on 27th March, 2023. 4.

Under such circumstances, petitioner has prayed for expeditious disposal of the case.

In view of such circumstances, the instant revision is disposed of directing the trial court to conclude the trial within August, 2023 and dispose of the above mentioned case as expeditiously as possible within September, 2023.
