Petitioner(s) Mr. Soumya Nag Mr. Aditya Tiwari ... for the Petitioner(s) Mr. Bitasok Banerjee Ms. Jonaki Saha ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner was granted liberty to approach this court after the evidence of the seizure list witnesses is over. Learned advocate for the State has submitted the evidence of the seizure list witnesses being examined as p.w.3 and p.w.4.

However, on an assessment of the evidence which has been deposed, I am of the view that the said two witnesses are supporting the seizure of the investigating agency, as such, there is no dilution in respect of the rigours of Section 37 of the NDPS Act in view of the quantum of seizure involved as a subject-matter of the present case.

Having considered the same, I am not inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Rejected.

Accordingly, CRM(NDPS) 397 of 2026 is dismissed. Photocopies of the evidence submitted by the State be kept with the record.
