The petitioner is in custody for about 230 days and prays for bail.
Learned counsel for the petitioner submits that charge sheet has been submitted. The petitioner has been falsely implicated. His further detention is not required. Learned counsel for the State produces the Case Diary and opposes the prayer.
I have considered the material on record. The petitioner has been identified in Test Identification Parade. One of the offending weapons, mobile phone and SIM cards have been recovered from the house of the petitioner pursuant to his leading statement. Material available in the Case Diary connects the petitioner to the alleged crime.
Upon consideration of the material on record as well as prima facie involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage. The application is disposed of.
Case Diary is returned.
