1. Affidavit of service filed is kept with the record. The writ application has been preferred praying for directing the respondents to engage such manpower in Group 'D' for rendering patient service in Seth Sukhlal Karnanni Hospital only from amongst those who are engaged directly by Rogi Kalyan Samity and paid salary from exchequer and further directed that the respondents to pay salary to such Group "D' staff at rate notified by the Labour Department of Government of West Bengal including arrears for the underpaid period and further direction to ensure service security of such Group 'D' staff according to wishes expressed by the Hon'ble Governor, West Bengal in a befitting lawful manner and other reliefs.

2. At this stage, the learned Counsels for the petitioners submit that it may be recorded, that they do not press for the reliefs prayed for in the writ application.

3. It is submitted that the only relief prayed for at this stage is that the Labour Commissioner West Bengal be directed to dispose of the representation dated 11.01.2019 filed by the writ petitioner within a time frame and dispose of the same in accordance with law on hearing the parties by passing a reasoned order.

4. It is further submitted by the learned Counsels for the petitioner that after the notice dated 20.01.2020 was issued by the Deputy Labour Commissioner (P) Kolkata, no further action has been taken by the Authorities concerned.

5. On hearing the learned Counsels appearing for both the parties, it appears that hearing was fixed on 28.01.2020 at 3:00 p.m. by the Deputy Labour Commissioner Kolkata (P) and the said note is at page 112, being Annexure 'P-11'.

6. As such on the submissions of the petitioner, the writ application is disposed of with the direction that the Deputy Labour Commissioner (P) Kolkata shall dispose of the representation

dated 11.01.2019 as per his notice dated 20.01.2020 within 60 days from the date of this order, on hearing all the necessary parties, in accordance with law, by passing a reasoned order.

7. The writ application is disposed of.

8. Applications, if any, connected thereto stand disposed of consequently.

9. Interim order, if any, stands vacated.

10. Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
