Learned advocate appearing for the petitioner submits that he has been arrested in connection with the instant case on the basis of statement of co-accused and there has been no seizure of any contraband from the possession of the present petitioner. Petitioner is in custody for about 7 months.

Learned advocate for the DRI opposes the prayer for bail and submits that the petitioner is a master mind. There are financial transactions between the person from whom recovery has been effected. There are also telephonic conversations which are available and surface in course of the investigation. Having considered that the quantity of contraband which has been seized in connection with the present case is 131.40

grams which is of commercial quantity and the petitioner was hand in gloves with the person from whom recovery has been made, at this stage, I am not inclined to release the petitioner on bail. Accordingly, CRM(NDPS) 398 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
