The present revisional application was preferred for quashing the proceedings relating to BGR Case No.5029 of 2011 arising out of Behala Police Station Case No.379 of 2011, under Sections 406/420/506 of the Indian Penal Code. As none appears for the petitioner on earlier occasion, Mr. Imran Ali, learned advocate was directed to appear for the State and submit a report from the concerned police station. The Officer-in-Charge, Behala Police Station has communicated to the learned advocate for the State and the report reflects that chargesheet was submitted after completion of investigation and the case is presently pending before the learned Judicial
Magistrate, 7th Court, Alipore. The report further reflects that next date has been fixed on 13th of July, 2022 for examination of the witnesses.
In view of the change of circumstances, I am of the considered opinion that there has been complete change of circumstances since the revisional application was preferred before this Court and as such, no interference is called for at this belated stage. Accordingly, the revisional application being C.R.R.598 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
