Mr. Pradyot Kumar Das .....for the petitioners Mr. Biswarup Biswas, Mr. Gora Chand Samanta ....for the respondent no.7 The writ petitioners claim that the private respondent has effected construction over the land belonging to them.
It appears from the records that the private respondent, namely Smt. Santibala Naskar was a permissive occupant in respect of the portions of the writ petitioners' land. Such land was given to the Irrigation Department for the purpose of digging a canal. The said Smt. Santibala Naskar subsequently obtained permission from the local Gram Panchayat to effect construction on such land.
This Court is of the view that the dispute between the parties and the Gram Panchayat cannot be entertained by this Court under Group IX.
This Court finds that the police have absolutely no role to play in the instant dispute.
The writ petition is, therefore, disposed of without any order reserving liberty to the writ petitioners to approach before the appropriate forum to agitate grievances against the Panchayat and the private respondent.
There will be no order as to costs.
