A direction to secure expeditious disposal of a Matrimonial Suit No. 709 of 2012 pending before the Court of learned Additional District Judge, 2nd Court, Howrah, is the ultimate relief sought for in this case. Admittedly, petitioner is the husband seeking dissolution of marriage.

Mr. Indrakant Jha, learned advocate for the petitioner submits that the suit is getting delayed for the adjournments being granted and till date, the cross-examination of the PW 1 could not be concluded, which commended on 9.9.2014.

The only contention expressed by the learned advocate for the petitioner is against the delay caused in the disposal of suit.

No other point is raised requiring address by this Court.

In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary upon the opposite parties.

Service of notice of this application upon opposite parties stands dispensed with.

Accordingly, learned 2nd Additional District Judge, Howrah in Matrimonial Suit No. 709 of 2012 is requested to ensure completion of the crossexamination of PW 1 within shortest possible opportunity, so as to ensure expeditious disposal of the suit, but without granting unnecessary adjournments, unless it is extremely unavoidable. While endeavouring such exercise, the year of institution of the suit may be taken into account, and opportunity of hearing must be extended to both the parties.

Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
