Petitioner Mr. Tapan Dutta Gupta Mr. Parvej Anam Ms. Rituparna Ghosh Mr. Sourav Sardar ...for the petitioner Mr. Sanjay Banerjee Mr. Saptarshi Chakraborty ...for the State Learned counsel appearing on behalf of the petitioner submits that the only material available against the present petitioner is the statement of a co-accused which is not admissible in evidence. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He submits that there are two persons who were carrying the contraband. It is suspected that the present petitioner is the one who had fled away. Apart from that, there are phone call conversations between the present petitioner and the arrested accused at the relevant time. Considering the above, the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
