The petitioner is the husband of the de facto complainant. On the basis of a written complaint filed by the de facto complainant/wife, Bidhannagar East Police Station Case No. 100/2020 dated 8.12.2020 under Sections 468/471 of the Indian Penal Code was registered. Subsequently, a joint petition for compromise has been filed stating, inter alia, that the dispute between the parties has been amicably settled. The husband and wife are living jointly. There is no allegation of forgery and creation of any false document by the husband for which the de facto complainant/wife is aggrieved.

On the last occasion, this Court directed the learned Public Prosecutor-in-Charge to submit a report of the Investigating Officer after recording the statement of the de facto complainant to ascertain as to whether such compromise has been effected without any threat, coercion or undue influence. The de facto complainant has submitted a written statement that there is no dispute at present between the parties. A compromise has been effected out of Court and she is residing with her husband and children peacefully. In view of such circumstances, the above-mentioned Police case corresponding to GR Case No.

the learned Additional Chief Judicial Magistrate at Bidhannagar be quashed.
