Report submitted by the Officer-in-Charge, Electronics Complex Police Station, Bidhannagar P.C through the learned advocate appearing for the State be kept with the record.

Record of this revisional application reflects that by an order dated 16.06.2011, a co-ordinate Bench of this court was pleased to direct that the investigation of this case will continue but the report in final form will not be submitted without the leave of this court.

Having regard to the fact that further investigation is progressing in resect of other accused persons, I am of the view that it would be the discretion of the concerned

investigation officer to see whether the present petitioner is involved in the offence or not and come to a finding at the conclusion of the proceedings.

Accordingly, the present revisional application being CRR 628 of 2011 is dismissed.

The investigating authorities would be at liberty to submit a report in final form against the present petitioner if they are satisfied with the fact that there was complicity of the present petitioner.

All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
