The revisional application was preferred in respect of order dated 10.8.2010 passed by the learned Judicial Magistrate, Krishnagar, Nadia in connection complaint case no.954C of 2002. Records of present revisional application reflects that the matter appeared on 13.6. 2011. The order which was passed for dismissal of the complaint. The order being passed under Section 256 of the Code of Criminal Procedure, has the effect of acquittal. It was incumbent to prefer an appeal, while revisional application was filed instead of the same.

Accordingly, CRR 632 of 2011 is dismissed.
