1. Matter is heard in presence of the learned advocates representing the petitioner and State respondents.

2. Petitioner claims being owner of a plot of land he has right to construct on the said plot of land which situates under the jurisdiction of Raninagar Police Station. However, it is alleged that private respondents are obstructing the petitioner from making construction over his plot of land and also restraining petitioner from enjoying peaceful possession of his land.

3. Learned advocate representing the State respondents has placed before this Court a communication dated 10th March, 2026 of one Sub-Inspector of Police, Raninagar Police

Station, Murshidabad and same is taken on record.

4. On perusal of said communication it appears that private respondents have also laid claim over the plot of land in question. However, it is disclosed that based on complaint of the petitioner Raninagar Police Station NCR No.

2429/2025 dated 8th December, 2025 was initiated.

5. From the submission made on behalf of the petitioner and contents of the communication dated 10th March, 2026 filed on behalf of the State respondents it appears it is an issue relating to claim and counterclaim by the petitioner and private respondents over plot of land where petitioner intends to make construction. This is not an appropriate forum to decide the claim of the petitioner over the plot of land in question and liberty is granted to the petitioner to take steps in accordance with law, if his title over the plot of land is disputed by the private respondents.

6. However, criminal proceeding has been initiated by the police authority based on complaint lodged by the petitioner, Court directs the concerned police authority to take criminal proceeding into logical conclusion.

7. With the aforesaid directions and observations writ petition stands disposed of.

8. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
