It is submitted by counsel for the applicant that out of seven persons, who are legal heirs of the deceased pensioner, one person, namely, Prodyut Kumar Chakraborty, eldest son of the deceased, is not willing to come forward to the concerned Treasury Officer to submit documents to receive his share of terminal benefits. 2.

As a consequence of the above, the concerned Treasury Officer is not in a position to disburse terminal benefits to the other six persons including the widow. 3.

In the peculiar facts and circumstances of the case, this Court directs 1/7 share of terminal benefits be paid equally to the six persons, who are willing to go to the concerned Treasury Officer and submit documents of identity and bank particulars. The share of Prodyut Kumar Chakraborty shall be returned back by the Treasury to the State.

The full family pension and arrears shall, however, be payable exclusively to the widow, Arati Chakraborty upon production of all documents and particulars of bank account.

The concerned Treasury Officer shall ensure strict compliance of the aforesaid order immediately upon receipt thereof.

Copy of the P.P.O. is kept with the record.

Hence, the contempt application is disposed of. Rule, if any, shall stand discharged.
