Leave is granted to the learned advocate for the petitioner to correct the Cause Title.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 180 days and has been implicated on the basis of the statement of the co-accused. It has been further contended on behalf of the petitioner that there were alleged seizure of 94.325 kgs of contraband/ganja from the possession of the other two co-accused persons.

Learned advocate for the State opposes the prayer for bail and submits that it was the petitioner who was supposed to receive the consignment. There are 102 calls between the petitioner and the co-accused between 07.04.2025 and 15.08.2025.

Having considered that a prima facie link has been established by the prosecution, at this stage, I am not inclined to release the petitioner on bail.

Learned trial Court would within a period of 45 days overcome the stage of consideration of charge and thereafter within a period of 45 days prepone and examine of seizure list witnesses. Petitioner will renew his prayer for bail after the evidence of the seizure list witnesses are over.

With the aforesaid observations CRM (NDPS) 403 of 2026 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
