N.D.Narayan v. Nirod Raj
02.3.2023 SB Ct. No.236 CRR 1441 of 1996 In the matter of : N.D. Narayan None is found present on behalf of the petitioner. This revisional application of 1996 challenges the order passed by the learned Judicial Magistrate, 2nd Court, Suri (Birbhum) in Complaint Case No. C.R. 296 of 1985 on 02.03.1996. By the impugned order learned Trial Court was pleased to reject the prayer under Section 205 of the Code of Criminal Procedure submitted on behalf of the accused person and directed the accused person to appear on 16.5.1996.
Since after filing of this application, none has turned up to support the contention of the petitioner there is every reason to presume that during the last twenty five years, this criminal proceeding has reached to its logical conclusion, particularly because there was no order of stay.
Under such circumstances, I do not find any reason to invoke the provision of Section 482 to quash the proceeding. The revisional application is dismissed, along with application if any.
The interim order, if any, stands vacated.
Let a copy of the order be sent to the learned Trial Court for information and necessary action.
