The petitioner is working as Assistant Teacher in the Kantamari FP School (Primary School) under Kultali South Circle, South 24 Parganas.

The petitioner seeks transfer to any school nearby to her residence within the same Circle on medical ground.

In the above circumstances, the DPSC, South 24 Parganas shall obtain an opinion of the CMOH, South 24 Parganas as regards the medical condition of the petitioner and as to whether based on such medical condition, it would be onerous to the health of the petitioner to

travel the distance from her residence to the school on daily basis.

Based on the medical opinion, the DPSC, South 24 Parganas may take a decision in the matter in accordance with applicable rules.

Let the above procedure be completed by the Chairman, DPSC, South 24 Parganas, within a period of 2 months from the date of receipt of a copy of this order. The entire procedure shall be conducted offline.

With the aforesaid directions, the instant writ petition is disposed of.

7.

There shall be no order as to costs.

8.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
