In the matter of: Niranjan Karmakar ... petitioner The present revisional application was preferred challenging the order dated 04.12.2014 passed by the learned District and Sessions Judge, Howrah in connection with Criminal Appeal No.53 of 2013 arising out of Misc. Case No.660 of 2012 pending before the learned 2nd Judicial Magistrate, Howrah.

The wife, after being aggrieved in respect of the order passed by the learned Magistrate regarding quantum of the amount of interim maintenance awarded which is `2200/-, approached the Appeal Court under Section 29 of the PWDV Act. The learned Appellate Court being the learned Sessions Court, Howrah had on appreciation of the materials and the fact that as the husband/present petitioner happens to be an engineer, learned Sessions Judge had directed that the interim maintenance should be paid to the tune of `6000/- per month from December, 2014.

Having regard to the reasons assigned by the learned Sessions Judge on the quantum of maintenance, no interference in the factual circumstances of the case is called for.

Accordingly, CRR 282 of 2015 is dismissed, pending application if any is consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this Court.
