02.
13.09.2021 S.D.
W.P.A. 5400 of 2021 Pintu Das Vs.
University Grants Commission & Ors.
(Through Video Conference) Mr. Shamim Ul Bari ... for the Petitioner. Ms. Hasi Saha ..For the Respondent No. 5.
Mr. A. K. Gupta ....For the U.G.C.
The petitioner appeared in NET JUNE- 2020 Examination for the subject Chemical Sciences jointly conducted by the Council of Scientific Industrial Research and the University Grants Commission. The result of the said examination was published in February 2021. The examination was a computerbased test. The petitioner was dissatisfied with the score obtained by him. He challenged the Model Answer Key in respect of the question ID 802437287 where the correct Option ID was given as 8024371148. According to the petitioner, the option in the Model Answer Key was incorrect. The petitioner accordingly challenged
the same and was successful. The final Answer Key recorded that the correct Option ID was 8024371145.
According to the petitioner, the Option ID as mentioned in the final Answer Key is also incorrect. The petitioner asserts that the correct Option Key is 8024371146.
The petitioner submits that according to the Rules, a candidate can challenge the revised Option ID only once and no further challenge can be put by a candidate. In view of the said Rule, the petitioner is unable to challenge the same once again as the online portal is not accepting such challenge. The petitioner accordingly made a written complaint and sent it through e-mail on 29.12.2020 and also on 27.01.2021. The said complaint filed by the petitioner has not been answered by the respondent authorities till date.
The learned advocate representing University Grants Commission does not have any instructions in the matter. As it appears that the representation filed by the petitioner is pending consideration at the end of the respondent authorities, accordingly no useful purpose will be served by keeping the writ petition pending.
The Council for Scientific Industrial Research shall take necessary steps for consideration of the representation filed by the petitioner and pass a reasoned order and communicate the
same to the petitioner at the earliest, but positively within a period of four weeks from the date of communication of this order.
The petitioner shall forward a copy of the representation and the supporting documents in aid of the answer which he challenges at the time of communicating the order of this Court. The writ petition stands disposed of.
There shall, however, be no order as to costs. Urgent certified copies of this order, if applied for, be given to the parties upon completion of necessary formalities. (Amrita Sinha, J.)
